Gwyneth Paltrow Is Going To Trial After Injuring A Person While Skiing
After injuring another person during a skiing collision in 2016, Gwyneth Paltrow is going to have to defend herself in court. The actress has been facing a lawsuit filed by Terry Sanderson, an optometrist, who says he was injured after Gwyneth slammed into him while skiing at Park City, Utah.
The incident happened seven years ago, but is only making it to court now, after both parties were unable to reach an agreement out of court. Terry was originally seeking $3.1 million in damages but has since lowered it to $300,000.
Terry says the encounter has left him with debilitating injuries for life, including a “permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement.”
However, Gwyneth has filed her own countersuit, and alleges the optometrist’s version of events is incorrect.
Gwyneth claims that Terry was the one who hit her from behind, and that she suffered minor injuries as a result. The actress is only seeking a single dollar in damages but wants all of her legal fees to be covered by the plaintiff.
The trial – which will determine who is liable for damages – began on Tuesday with the attorneys’ opening statements. It’s unclear when Gwyneth will be required to testify in person.
In 2019, the same year he filed the lawsuit, Terry originally tried to classify the accident as a hit and run, though the request was turned down by a judge.
Court documents accuse Gwyneth of “ignoring, denying assistance to, and skiing away from Plaintiff,” and says she “accepted no responsibility” for the accident.
Conversely, Gwyneth says she only left the scene after a resort employee gave her the go-ahead. The Goop founder says she doesn’t have a strong recollection of the incident, and that her memory was affected when she got injured.
Terry has also claimed that an employee who witnessed the crash skied off after implying he was responsible for the collision. However, a judge has ruled this is not allowed to be mentioned in the ongoing court case.
It's been questioned why the plaintiff waited three years after the accident to file a lawsuit. Terry has said the delay was caused by attorney issues as well as medical problems caused by the concussion he sustained.
