Kevin Costner Claims Estranged Wife Is Defying Prenup By Refusing To Move Out

It seems that having a prenup doesn’t always make a divorce simple. Kevin Costner is claiming his estranged wife Christine Baumgartner is defying their prenup by refusing to move out of their home after she filed for divorce earlier this month.

“Christine has not moved out, despite multiple requests that she do so and despite Kevin’s offers to assist her financially in relocation to a new residence,” his lawyers wrote in court documents.

“Instead, Christine has taken the position that she will not move out of Kevin’s separate property residence unless and until Kevin agrees to various financial demands,” the filing continues.

According to their prenup, Christine must vacate their shared property within 30 days should they divorce. The home is listed as a pre-marital asset, as Costner purchased it in 1988, over a decade before they wed.

Kevin and Christine, a handbag designer and model, married in 2004 after four years of dating. They have two sons and one daughter.

Known for movies like Dancing with Wolves and The Bodyguard, and the star of the hit show Yellowstone, Kevin has amassed a reported net worth of $250 million.

Despite having been married for nearly two decades, and Kevin’s large net worth, the prenup reportedly only entitles her to $1 million in the case they should divorce. The prenup also required Kevin to pay her $100,000 when they married as well as on their first anniversary.

Kevin’s legal team says he’s made all payments to Christine, as stipulated in their prenup, including the $1 million.

The prenup apparently also requires Kevin to give Christine $200,000 when she buys a new home plus pay the property tax and insurance for a full year. He’s also offered $30,000 per month towards rent until a permanent home is secured plus $10,000 towards moving costs.

Since Christine has not yet moved out, it’s unclear it Kevin has paid any of the aforementioned payments. The estranged couple continue to battle their divorce out in court (and the media).

Kevin experienced a huge blow to his net worth after his first divorce, which reportedly led him to sign an iron-clad prenup the second time he walked down the aisle.

Kevin’s first marriage was to actress Cindy Silva from 1978 to 1994. They reportedly split due to Kevin’s busy schedule, which had an impact on their relationship. They share three children.

Cindy got an $80 million divorce settlement, making it one of the most expensive divorces in Hollywood. But it looks like Kevin won’t be making the same mistake twice.
